Civil Contractors New Zealand made a submission on the Commerce (Promoting Competition and Other Matters) Amendment Bill.
While CCNZ’s submission supports moves to combat anti-competitive behaviour, it also raises key concerns about the scope of the Commerce (Promoting Competition and Other Matters) Amendment Bill.
CCNZ warned broad application of the “substantial market power” test could stifle both genuine competition and established collaborative models like joint ventures and alliances that are critical for the construction sector.
CCNZ recommended the Commerce Commission grant class exemptions for collaborative conduct, and urges caution with new predatory pricing controls to ensure industry collaboration and charitable activities aren’t unintentionally penalised
